Terms of Service
Last updated: July 16, 2026
These Terms of Service (“Terms”) govern your use of foreverbathsd.com (the “Site”), operated by Forever Bath & Shower Inc. (“Forever Bath,” “we,” “us,” or “our”), a California corporation. By using the Site, requesting an estimate, or contacting us, you agree to these Terms. If you do not agree, please do not use the Site.
The Site is not a contract. Nothing on this Site is an offer, a binding quote, or a promise to perform work at a particular price. If you decide to move forward, the work will be governed by a separate written home improvement contract that you sign. That contract — not this Site — controls the scope, price, schedule, and warranty for your project.

1. Who we are
Forever Bath & Shower Inc. is a California corporation (Secretary of State entity no. B20260006391) with its principal office at 7509 Draper Ave, Unit 206, La Jolla, CA 92037. We perform walk-in and step-in shower installations, tub-to-shower conversions, and aging-in-place bathroom remodeling for homeowners in San Diego County.
Our California Contractors State License Board (CSLB) license number is listed in the footer of this Site and on every written contract we issue. You can verify any California contractor’s license at cslb.ca.gov.
2. Site content is informational
The Site describes the kind of work we do. Photographs show projects we have completed; your home, your existing plumbing, your walls, and your selections are different, and your finished result will differ. Product names, colors, finishes, and availability are subject to change without notice. We try to keep the Site accurate and current, but we do not warrant that it is free of errors or omissions.
3. Estimates and pricing
Any price, range, or estimate you see on the Site, receive through the Shower Fit Guide, or discuss with us before a written contract is signed is preliminary and non-binding. It is based on the limited information available at that moment.
A firm price requires an in-person or verified measurement of your bathroom. Conditions that are not visible until demolition begins — such as concealed water damage, dry rot, mold, failed subfloor, non-compliant framing, or plumbing and electrical that must be brought up to code — can change the scope and the price. Any such change will be handled through a written change order that you approve and sign before that work proceeds, as California law requires.
4. Your written contract controls
If you hire us, you and Forever Bath will sign a written home improvement contract before work begins. That contract contains the full and final terms of our agreement, including scope of work, total price, payment schedule, approximate start and completion dates, permit responsibility, warranty, and dispute resolution.
If anything on this Site conflicts with your signed contract, your signed contract governs. Nothing on this Site amends, replaces, or waives any term of a contract you have signed.
5. Your rights under California law
Nothing in these Terms limits, waives, or shortens any right you have under California law. That includes, without limitation:
- Your right to cancel a home solicitation contract by midnight of the third business day after you sign — or the fifth business day if you are 65 years of age or older;
- Your protections under the California home improvement contract statutes (Business and Professions Code § 7150 and following), including limits on down payments and progress payments;
- Your right to file a complaint with the Contractors State License Board; and
- Your rights under the Consumers Legal Remedies Act and other California consumer protection laws.
Any attempt in these Terms to limit liability or disclaim warranties applies only to the fullest extent permitted by law, and never to rights that California law makes non-waivable.
6. Information you submit
When you send us a message, complete the Shower Fit Guide, or give us details about your bathroom, you agree that the information you provide is accurate to the best of your knowledge. We rely on it to prepare recommendations and estimates; inaccurate information will produce an inaccurate estimate.
You agree not to submit anyone else’s personal information without their permission. How we handle what you send us is described in our Privacy Policy.
7. Calls and text messages
By giving us your phone number, you agree that we may contact you at that number about your inquiry and your project, by call or text, including through an automated system. Consent to marketing messages is not a condition of purchasing anything from us. Message frequency varies, and message and data rates may apply. Reply STOP to any text to opt out, or HELP for help. Full details are in our Privacy Policy.
8. No medical or professional advice
We build bathrooms that are easier and safer to use. We are contractors, not doctors, occupational therapists, or accessibility consultants. Nothing on this Site is medical advice, therapeutic advice, or a clinical assessment of anyone’s needs or abilities, and our products are not medical devices. Grab bars, benches, and low-threshold entries reduce certain hazards; they do not eliminate the risk of a fall or injury. For guidance about a specific medical condition or mobility need, please consult a qualified healthcare professional.
We install to applicable building codes. If you need a bathroom that meets a specific standard — such as ADA requirements for a public accommodation — tell us before you sign, so it can be written into your contract.
9. Our content and photos
The Site and its contents — text, photographs, layout, graphics, and the Forever Bath & Shower name and logo — are owned by Forever Bath or used with permission, and are protected by copyright and trademark law. You may view and print pages for your own personal, non-commercial use in evaluating our services. You may not copy, republish, sell, or use our content or photographs for any other purpose without our written permission.
The installation photographs on this Site are of real projects we completed, published with the homeowners’ permission.
10. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms;
- Submit false, misleading, or fraudulent information, or impersonate anyone;
- Send automated or bulk submissions through our forms, or attempt to defeat our spam protections;
- Attempt to gain unauthorized access to the Site, our systems, or any data;
- Introduce malware or otherwise interfere with the operation of the Site; or
- Scrape, harvest, or systematically collect content or contact information from the Site.
11. Third-party links and lenders
The Site may link to third-party websites, including financing partners and product manufacturers. We do not control those sites and are not responsible for their content, products, terms, or privacy practices.
If you apply for financing, your application is between you and the lender. The lender sets its own rates, terms, and approval criteria, and its decisions are its own. We do not make credit decisions and we do not guarantee that you will be approved or that any advertised rate will be available to you.
12. Disclaimer of warranties
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties regarding the Site, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
This section is about the Site only. It does not affect the warranty on work we actually perform. Our workmanship warranty is stated in your signed contract, and we back it in writing.
13. Limitation of liability
To the fullest extent permitted by California law, Forever Bath will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site, and our total liability for any claim arising out of the Site will not exceed one hundred dollars ($100).
This limitation applies to the Site. It does not apply to, and does not limit, our liability for the work we perform under a signed contract, for personal injury caused by our negligence, for fraud or intentional misconduct, or for anything else that California law does not permit us to limit.
14. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of your use of the Site will be brought in the state or federal courts located in San Diego County, California, and you and Forever Bath consent to that jurisdiction.
Disputes about a project we contracted to perform are governed by the dispute resolution provisions of your signed contract, which may require arbitration. Read your contract before you sign it.
If any provision of these Terms is found unenforceable, the rest remain in effect.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page. Your continued use of the Site after an update means you accept the revised Terms. Changes to these Terms never modify a contract you have already signed.
